Surviving a Layoff Conversation

Scene: A calendar invite titled "Quick sync" appears with no agenda. You walk in and find your manager sitting beside someone from HR you have never met. You already know what this is.

Manager: Thanks for coming in. There's no easy way to say this, so I'll be direct. The company is restructuring, and your role has been eliminated. This decision is final, and it isn't a reflection of your performance. I'm truly sorry.

You: That's difficult to hear, and I appreciate you being straight with me. I'd like to understand the details before we go further. Could we walk through the specifics one at a time? I'm going to take a few notes so nothing gets lost.

HR: Of course. Your last working day will be the end of this month. You'll receive a severance package of eight weeks' pay, and your health insurance is covered through the following month. Everything is written in this document, which you can review at home.

You: Thank you. I won't sign anything today — I'd like a chance to read it carefully and possibly have it reviewed. Two things I want to confirm now: will my unused vacation days be paid out, and what happens to the stock options I haven't vested yet?

HR: Unused vacation is paid out in your final check. As for the options, only the portion that has already vested is yours to keep; the rest is forfeited on your last day. I'd encourage you to read the equity terms closely, since the exercise window is limited.

You: Understood. One more thing that matters to me: as I start looking for my next role, can I count on you for a positive reference, and would you be open to confirming my title and dates to future employers? A short note on LinkedIn would mean a lot, too.
